Magistrate Courts
The Magistrate Court is comprised of a Principal Magistrate, Senior Magistrate, and Magistrates. They serve as the subordinate courts of first instance in both civil and criminal matters, excluding those within the jurisdiction of the Swazi National Courts, the Industrial Court, and the High Court.
The Magistrate Court in Eswatini has jurisdiction over criminal cases involving less serious offenses. These may include minor assaults, theft, traffic violations, and other misdemeanor offenses. The court ensures fair proceedings and imposes appropriate penalties within its jurisdiction.
The Magistrate Court also handles civil cases, including property disputes, contract matters, debt recovery, and family-related issues such as divorce, child custody, and maintenance. It provides a local platform for resolving various civil matters in a fair and efficient manner.
Magistrates, appointed by the Judicial Service Commission, preside over cases in the Magistrate Court. They have the authority to hear evidence, make judgments, and issue orders within their jurisdiction. In some instances, they may conduct preliminary hearings before transferring serious offenses to the High Court.
Decisions made in the Magistrate Court can be appealed to the High Court by either party if they are dissatisfied with the judgment or believe there was an error in the proceedings. The High Court has the power to review the lower court's decision and either affirm, reverse, or modify it as necessary.
